By visiting, viewing, browsing our website, and/or submitting an order, you agree to be bound by the following terms and conditions, as a binding legal agreement between you and gardenia.com, without limitation or qualification. Gardenia may terminate this agreement unilaterally at any time.
If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
We reserve the right to amend these terms from time to time without notice, and it is your responsibility to check the most current version of the Terms & Conditions on our page, as any changes are binding to you. Your continued use of our website following the post of any changes means your acceptance of those changes.
You must be 18 years of age or older to use our website and/or order products from gardenia.com. You represent that you are 18 years old or over the age of 18 years old by accessing this website.
Membership
When you register as a member of Gardenia you will be required to provide a “username” and a “password”. Each username is unique. Your password is known only by you, you can modify it anytime you want, and it is your responsibility to protect the confidentiality of your password. In no event, Gardenia will be held liable for any problems linked to the disclosure of your password. Gardenia does not share users’ info with third-party companies.
Visitor Material and Conduct
By using the website, you are bound to provide true, complete, and accurate information about yourself, and you warrant that you are not using a false name or impersonating another person/entity.
Under no circumstances shall you use gardenia.com to defraud, threaten or abuse others, commit theft, and/or violate any law. You are prohibited from posting any obscene/abusive/pornographic/discriminatory/blasphemous material on this website, uploading any technically harmful material (such as, and without limitations, worms, viruses, malicious software, or harmful data), and collecting personal information of others. You may not misuse this website by hacking, spamming, or phishing.
Any breach of the terms of this agreement will lead to terminating your use of this website.
License and Copyright
Gardenia grants you a limited, non-exclusive, revocable, and non-transferable license to access and make personal and non-commercial use of this website and its contents.
You may not resell or commercially use the website and its contents, you may not copy, modify, or distribute all or part of Gardenia’s online copyrighted content, and you may not misuse this website by violating our intellectual property rights or the intellectual property rights of others.
Except for your personal information which is covered by our privacy policy, any material you post to this website shall be considered non-confidential and non-proprietary.
Any unauthorized use will lead to the termination of the licenses granted to you, as well as your use of this website.
Orders
Your order will be submitted once you click on the “checkout” button; please check the information you provided is correct before clicking on the “checkout” button. Acceptance of your order will be when you receive a confirmation email from Gardenia with an order number.
We reserve the right to cancel your order at any time (if, for example, if the information you provided is inaccurate, we are unable to receive authorization for your payment), and we will let you know if we cancel an order.
Cancellation & Refund
Should you cancel your order 24 hours before Delivery we will refund your order. Please note we cannot refund orders canceled within 24 hours of the scheduled Delivery timescale, or should the recipient refuse the order upon Delivery. This is due to the perishable nature of the product.
Gardenia may have to cancel your order (if for example, the product you ordered is not available, the Delivery address you provided is not within your covered area, there was a problem with your order and we were unable to contact you for more than two days), in this case, you will receive a refund. This does not apply to wrong recipient information.
At Gardenia, we do our best to deliver the freshest flowers and plants. If for any reason your order arrived damaged, please send us an email with a photo of your order within two hours of Delivery. We will be happy to replace your order or issue a store credit.
Delivery
It is essential that you provide a complete and detailed address & mobile number; inaccuracies in your details may lead to problems and/or delays in Delivery. If the recipient is not at the mentioned address, we will not deliver your order to a third party or to another address.
Price and Payment
For each product or service you purchase from our website, you agree to pay the price applicable for said product or service at the time you submit your order.
Payments for our products and services can be done via debit/credit card through our website. Credit or debit cards used to pay an order must belong to the user; otherwise, the user has the responsibility to receive legal authorization from the card’s owner.
You may cancel any order within 5 minutes of placing it on our website. A debit/credit card refund takes from 2 to 7 days to process. We will send you an email that contains the refund advice from the debit/credit cards bank payment gateway so you can follow up with the bank in case of delays.
Governing Law and Jurisdiction
These Terms shall be subject to the laws of the Kingdom of Saudi Arabia, and any dispute arising in connection with these Terms shall be under the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.
Limitation of Liability
Gardenia will not be liable for any issues or viruses that may damage your computer, phone, or any electronic device you use to access our website and download any information or material from it. In no event will Gardenia or any of its owners, employees, affiliates, directors, agents, nor any person involved in the creation, production, or transmission of this website, be liable in case of any indirect, direct, special, or consequential damages (including, without limitation, those resulting from lost profits, loss of data, lost opportunity, or business interruption) arising from the use, inability to use, tort, or the results of the use of this website.
Gardenia does not exclude or limit in any way its liability for death or personal injury caused by our negligence of that of our employees.
Security
We take the necessary technical and administrative measures to protect your personal information from unauthorized access. Unfortunately, no security system is 100% secure, consequently, any information you provide us is done so at your own risk.
Due to the fresh nature of our products, colors, and types may vary depending on the season.
